No double jeopardy, the case can be revived without prejudice... Case resumes where it left off.. Amnesty as basis of the dismissal in 2011 was found wanting for it failed to satisfy the stringent requirements of our Constitution.. Like pardon, it is the sole prerogative of the president, the signing of the certificate of the amnesty cannot be delegated, as the same is not a mere ministerial or administrative act. Firstly, before its granting, the applicant must strictly comply with the prerequisites set forth by the fundamental law, our saligang batas. The grantee, despite of his day in court, failed to present competent proof to sustain his continued liberty via that amnesty. Amnesty should be given only to rebels and secessionists who were the enemies of the State.. Such is the spirit of Amnesty.. It cannot be extended to rogue soldiers and other ranking officers of government, who swore to be the protector and defender of the State and its duly constituted authorities. They should not be nursed or pampered but incarcerated for treason.. The constitution should be amended accordingly to this end.. These Pasaways violated the law but rewarded with privileges and positions in the government.. There will never be stability in this country, for the precedence as set forth.
History will repeat itself unless we make necessary corrective actions.. We must uphold the letters of the law and not twist it to our own liking... Just my thoughts, though..

Sen. Trillanes lost in the trial court because the judge were either afraid of Dutae or he's in Dutae's pocket. Tis is the only reason I can think of.

Banana court. So on what did Alameda based his decision last 2011 when he dismissed the rebellion case against Trillanes? Just goes to show judges base their decisions on the political climate of the time. This judge should be suspended for giving a decision without basis.
