I got hammered (twice) for the same piece of music which was in the Public Domain! But Sony (of course) had a version of it, I got slapped. I didn't have the time to file a third one because the moment the video covered had passed.

ОтветитьI have also faced it. Whenever my video starts getting views, I get a copyright strike from random unknown names and not from the actual music company or the original artist.
ОтветитьI know of at least 3 channels with 500k-1 million subscribers running copyright scams. What they do is download public domain or CC0 videos. They digitally restore, upscale them, and do some slight edits. They now have copyright to the restored upscaled video. They post the video for monetization on their channel, upload it to internet archives, and other large video library repositories showing it's copyrighted. They then start doing copyright claims on all channels that have the original still public domain video making it non existent. So now the only way to watch the content is through their monetized channel.
ОтветитьJust had one for a daft version of Dancing Queen by ABBA that I made (with lots of rubber pig juiciness), but the claim comes from a cheesy Spanish language cover from the 70s. I've disputed it, I have no problem risking my account to see it through...

Hi Paul, how do the covers and karaoke claim they have the copyright to those songs? Wouldn't they need to prove the original copyright? Under DMCA (Digital Millennium Copyright Act), the intentional filing of a false claim/infringement will leave the filer liable for any damages incurred, including attorney's fees and ad revenue that was generated.

Paul, who do you use to have your content covered by copyright? MusicNotes? MySheetMusic? Or the individual publishers? I have a small channel but am trying to figure the best way to do the right thing with the charts and tab I make available, and as you say, finding out the right information is not always easy. Anything you can add or offer would be much appreciated!🙂

ОтветитьAgain, LatinAutor. This company is responsible for many bogus claims, saw this in other channels. They made a claim on a song OWNED by the person on the channel.
ОтветитьNot sure where you live, but here in the US, You have a right face your accuser! In a court of law all names of everyone filing the claim will be on the papers they serve you, so you can defend yourself, and gather evidence for yourself too, and I never understood why that doesn't also count in other situations like the one with the Dick Dale song for the very same reason! I also heard that some have brought suits against google for doing that, but didn't win even though they should if it's the case! It's a false accusation, and add to that that they are literally taking money from you which they can if it's true if your contract states it and you sign it, contract aside and no matter what it says if you didn't do it then it's a different story, because there are things not allowed in contracts, and if they try to enforce it they are breaking the law, and them even taking one dollar can be considered theft or the same under different legal term. Add to that, it's also unfair business practice; another charge, and since they take your revinue and keep the video up, then they are violating the copyright themselves!!! Smells like a class action waiting to happen!
If you don't have similar laws wherever you are, then if I am correct, you may still have a right to challenge them in court here because their headquarters is here! Even the claimant can be charged, for a few things.
I had Warner make a claim against a 1929 song I used from Blimd Blake that was specifically pulled from Wikimedia commons. Fortunately on submitting the Library of Congress numbers that clearly listed it as public domain, the dispute was lifted.
From several folks I talked to though, it seemed a common theme that Warner was the worst in claiming what was not theirs.
So let me understand. An artist that steals copywritten content for their video, claims that you have infringed on their stolen content.
ОтветитьIt would not be unreasonable for YT to track claimants and suspend them if their claims get challenged too often. At the very least it would force them to frequently create new email and YT accounts.
ОтветитьI would hope that Sunday general AI or super AI will get involved to stop these fraudulent copyright claims from victimizing people who are not infringing on anyone.
ОтветитьI would say 80% of my playing in my videos gets “claimed” under copyright, these are improvised drum beats or grooves that under US copyright law can’t be claimed but they still put a claim on them. I have so far successfully appealed them all….so far.

ОтветитьI had claim come from UMG on an original song of mine. It claimed that a section of my video was identified as Under Pressure by Queen. Not even close. I did dispute it, but instead of doing the right thing and releasing it quickly, they let the 30 day clock run out so it released automatically. I know it's released, but the point is that they chose to let it hang in limbo for 30 days. Frustrating, and doesn't protect the little guy.

ОтветитьI have had a web presence since 1999, back before YT when the web was still mainly inhabited by legit geeks like me.
I took down all my YT content a couple of years ago, it just isn't worth the worry.
I feel bad for those creative people who have built a business on original content, only to have it spoiled by con artists, and trolls.
The penalties should be harsher, but how do you enforce them on anonymous rogues hidden behind identities in some 3rd world location with no respect for international law?
What is needed is a complete redo of Copyright Law. Society is attempting to copy and paste centuries old laws into modern life with all the digital needs of artists today and it just doesn't work anymore so just like we need to rebuild our monetary system we need to rebuild from the very beginnings of copyright law all the way back to the days of the printing press and re-examine and let society determine what is really copyright and what is art.
ОтветитьSony, BMG, they don't care. They'll submit claims for everything and all the things in the hope that you don't/won't fight it. If it's a sample of a sample of a song from their catalog, you'll know.
