BTW, great shooting. I have always said that women are natural shooters. I am all for any lawful citizen of this great nation to be able to defend themselves. Just because a person uses medical marijuana doesnt mean they should have their 2nd Amendment right to bare arms to protect their lives and their property taken away from them. My comment below was to clarify why the ATF has made notice to medical marijuana users why they cant own firearms. It doesnt mean I agree with it.

@WhiskyTangoFoxtrot33 Valid points, however the form does use the language "unlawful user" which implies that there are, or at least can be, lawful users. If it were meant to be an absolute prohibition it would just say "user". You'll also notice that the form asks about felony indictments or convictions in any court, meaning Federal, State, and Local. So if they take state laws into account for questions 12b, 12c, 12h, and 12i, why do you think they ignore state law on question 12e?

@JethroXP The "unlawful user" language applies to controlled substances, i.e. perscription drugs etc... not marijuana. Marijuana, medical or not, is still considered illegal in the federal goverment's eyes. Thus, it is a disqualifier on Form 4473. In regards to felony convictions, there is no state that allows a person to own a firearm if they have a felony conviction. The ATF puts this langauge in so that an applicant understands that it doesnt matter if a felony conviction is state or federal.

@WhiskyTangoFoxtrot33 Sorry, the form doesn't say any of that, so you can't just assuming all those legal gymnastics exist in the absense of supporting language. Question 12e clearly asks "Are you an unlawful user of, or addicted to, marijuana..." There are no if's, but's, or qualifiers. If you are a lawful user in your state, and not addicted, the correct answer to this question would be "No".

@JethroXP Again, Form 4473 is a federal form, not a state form. FED law supercedes any state law. The state is the one the issues a MM license, not the fed gov. The FED does not recognize any MM license or MM use as being legal, period. If you dont believe this, call the ATF and ask them. They will tell you that if you are a MM user that you cannot, by FED law, own a firearm. Even if you have a MM license it doesnt make its use legal in the FED's eyes.

Im not trying to argue with you. I have filled out Form 4473 many, many times. Im a designated firearms collector in my state and I also own multiple Class III NFA firearms. I know the laws, State and Fed, very well. Im not the one you should be arguing with. Call the ATF and ask them. There is no higher party to the ATF. They run the show when it comes to firearms. Call them.

@WhiskyTangoFoxtrot33 Based on the letter that have sent to Firearms dealers in states that do license medical marijuana use I have no doubt what they will say. I believe it is wrong, and needs to be challanged. And I'm pointing out that the language of the form itself leaves open the possibility that lawful MM users can legally own firearms. That's why they needed to send the clarifying letters, because the form doesn't say any of that. I'm also a collector, and have a C&R FFL myself.

Then you should know that if they spelled out every little detail the Form 4473 would be a mile long. It is the applicants responsibility to know both the federal and state laws for firearm ownership. The fact is, there ARE certain controlled substances (i.e. prescription meds) considered LEGAL with a prescription in the FED's eyes. BUT, Marijuana is NOT one of them. FED law says marijuana is illegal, period, presrciption or not. They do NOT recognize a prescription for it as legal.

@JethroXP I think you have missed the fact that I am all for MM, and for MM users to own firearms to protect themselves. I dont think people should have to give up their 2nd Amendment right just because they have an illness. But, the law is the law. Federal Law says marijuana, and its use, is illegal. There are no exceptions to this. A state licensed MM user is still breaking Federal law when using marijuana no matter how you look at it. My suggestion, call your congressman and file a complaint.

What I'm talking about is the fact that it makes references to non-federal jurisdictions, and uses specific language that seems to leave open the possibility of "lawful users". The entire form is an absurdity. You had really great form, you obviously had an instructor with a clue. Next time you go shooting you might want to consider a couple slight changes that may make shooting with a long arm easier. The first is to shift your weight to your forward leg a bit more, so you are leaning in just a bit. The second is is to push out your tummy. Spines are "S" shaped dynamic tension structures and pushing out there makes your upper back stronger & more capable of handling the awkward front load.
