The only things I find sad are that this selfish family did this to these kids and their father and his family. No sympathy at all. They tried to leave the country to a country they couldn’t be removed from to face charges. Sorry that’s enough for me to say they are more involved than they want to say. No sympathy. They should have taken a different route from the beginning.

I don’t know why people think being mirandized is like how it is in the movies. When people are arrested, cops don’t have to mirandize you on the spot. They ONLY have to mirandize you if you’re not free to go AND you’re being questioned/interrogated.

So let’s break this down…

Susan gets arrested. Susan is brought to an interrogation room but the cops don’t ask her any questions. Susan volunteers everything and doesn’t stop talking. Cops don’t need to mirandize her. (Look up the case of Shayna Hubers. She spoke for hours, was under arrest, the cops didn’t mirandize her bc they didn’t ask her questions, AND the video was admissible in court)

Susan is NOT arrested (she is free to go) and cops called her in to ask her questions. Cops do NOT need to mirandize her.

Susan is arrested and cops are asking her questions/interrogating her. They need to mirandize her bc she is being questioned and not free to go.

Also, Miranda rights are not like in the movies (again) Miranda rights are only told to you so that you know you have the right to an attorney and the right to not incriminate yourself. While it informs you of your constitutional rights, the act of being mirandize is not a constitutional right. So if a cop doesn’t mirandize you when they should, the only repercussions would be that that information you provided can’t be used against you. Cops won’t lose their jobs, your case doesn’t get dismissed bc of that, etc. Cops just can’t use that information against you. The judge will suppress that information.


Uffff - I just heard him bring up the example that someone gave about if the cops ask her her name and she admits to the crime (the spontaneous utterance) and he said he has argued that it could be suppressed. Eeeekkkkk. That’s not actually true. Spontaneous utterances are just that. It wasn’t elicited by law enforcement. Just an fyi - I’m a federal officer (in Florida) and I have prosecuted about 20-30 criminal cases. I’ve also worked with local law enforcement and have assisted with their arrests. Not ONCE have I read them their Miranda rights when I arrested them. It was always before the interrogation, and their statements have never been suppressed. A lot of them actually had spontaneous utterances that WERE used against them.

Here’s a perfect example.. a cop could arrest you, not mirandize you and put you in his car. If there’s a recording, then it’s fair game and could be used against you.

I agree it’s sad for the Grandkids and kids, but all the adults involved in this case, I do not feel sorry for her regardless of age. After all the videos I have watched and listened to, Donna was balls deep in being involved. One thing being overlooked is the cold blooded of murder of Dan Markel, let’s not forget the victim in all this. She is paying the price of her actions, as we know she did not have to pull trigger, but guilty by her involvement. They may have done thorough search as she had indicated in evidence from wire taps, that she said she would take overdose of meds.

Dear Law Enforcement officials, can you please explain why so many body cam videos (not this 1) show subjects begging questions to the police but the police refuse to answer very basic questions like why they are being detained, arrested or harmed but the police are screaming demands while the citizens are crying. I have utmost respect for law enforcement but more often than not police take things to a level that would not have happened if they had answered a couple of basic questions. I appreciate your time and thank you Peter.

She doesn’t seem surprised but she thinks Rashy is going to get her out. I really don’t think she has any idea what this means long term. She may never talk or see Charlie again. Robert and Wendi are not speaking to her. Harvey may be arrested in the future. It is a good thing they have lots of money to pay for attorneys. Rash is probably happy he will make anther million or more with Donna.
