Does this political decision, and other political advertisements which could alienate customers, utilizing Ben & Jerry's corporate resources, social media and website, constitute a violation of the fiduciary responsibility to generate value for shareholders? For example, does promoting marijuana legalization violate fiduciary responsibility if the corporate decision-maker has an undisclosed financial interest in marijuana legalization, and is making decisions which benefit themselves and another unrelated corporate interest over the best interests of Ben and Jerry's share holders? If so, would this also apply to undisclosed financial interests relating to the BDS organization, political fundraising and shared political objectives?
