An easement to a landlocked property can be obtained by one of two ways. First you can purchase an easement from an adjacent land owner. Often this can be very expensive and requires the land owner two either give or to sell you this right. The other is an easement by a controlling government agency. The court can create an easement or the state, city or county can do it by emanate domain. Both of those require a good public reason to be done. It is really just those two way it can be done.

I have a lot that is the second lot back from the main road. There is a plotted road to access my lot and others but it was never built. Are we able to use this easement?
how would you go about it?

I have a question. If the road(public) is already on the tract map with name, will it be more easy for me to ask/apply for government construction?

What if you didn’t know you were buying an easement? Then found out you bought an easement. No knowledge that it is a private drive to one home owner? Then I can’t use it. I can’t block this off (even if legally bc that owner is a disabled lady so morally wrong). What can I do to get out of this sale? It was bought from a land auction from commissioners auction.

But who is responsible for the easement financial responsibilities and maintenance the land owner or the easement owner and what are the rights if use. I have a easement across my land and the people who use it which is part of my driveway rave across it and I have little children and animals playing which is all in my front yard? Bet that's a hard one to answer lol

Tell me more about solar easements.. is that like, if you live 2 blocks from the beach, and some one builds a big house 1 block from the beach, blocking your sun, and your view of the beach in general?

My neighbor and I purchased foreclosure vacant land from the bank within the past 10-years. He has a legal and recorded 20' easement along the full length of his south lot line in order for me to be able to access my property. He knows this and owns his own construction firm yet still placed his fence on the lot line. This has completely blocked the legal easement and access to my property. He has even illegally graded across MY south lot line, where there is no legal easement, in order to have access to the road next to me. In the process he pulled out all of our survey pins along our south lot line. Please tell me if this is the correct course of action I should take: 1. Have a surveyor restake the lot pins/corners, 2. Send a Demand Letter to move the fence behind the legal and recorded easement on his property, 3. Take him to the appropriate civil court should he not move the fence by a certain date.

Is there another course of action I should consider?
Would I have any right to bulldoze his fence off of my legal easement?
