Teaneck's Town Code makes the legal status of the Site Plan Advisory Board (SPRAB) clear. Relying on support from the relevant state statute, Teaneck’s code goes on to describe a required entity whose members (9) eligibility requirements would bring a level of professionalism and training to the evaluation of development plans and projects that Teaneck badly needs. Provision to assure that the SPRAB recommendations would not delay needed action are carefully-woven into this well-written code.
Incredibly, that required Board has no current members. It is not even listed on the Town Website among Town entities. Residents from all over Town have begun to ask the question: Why doesn’t the Town have a functioning SPRAB?
In a carefully arranged dialogue, during the 2/8 Council mtg., DM Schwartz asked the Town Attorney to opine on whether the Town had to – and should – have a Site Plan Review Advisory Board. No Surprise. He obfuscates but seems to suggest an SPRAB isn’t needed – which satisfies DM Schwartz. Watch/Listen to this 3-minute video – and then go back and read Sec 33-16 of the Code on the website and see if you can make any sense of the Attorney's answer.
