I’ve had several attorneys tell me one thing different. They say you need to positively state that you are exercising your right to remain silent. Now the fact that you haven’t said anything at all, may make that scenario different.

The only time I went through a checkpoint, I had just been at a wedding and we were going to in-n-out I believe. Fortunately for me, the bar wasn't an open bar, and so I maybe had a beer and the free glass of champagne everyone got over the span for 3-4 hours. So when I got to the checkpoint and they asked if I had drank anything, I said a glass of champagne but that was over an hour ago (I may have been too poor to even buy a beer at the time lol). He just checked my eyes and waved me on.

Now I know not to say anything; I was only 22 or 23 at the time and didn't have the same impulses as I do now. But I also now have a breathalyzer, a fuel cell based one that's accurate enough for government work, so to speak. I only ever drive I've I'm below 0.04% because that's generally the limit in which most people will have very limited impairment (CDLs and other countries have 0.05% as their limit for this reason). I know technically the law and science claim any alcohol can cause impairment, but realistically, they've only studied levels about about 3%, and even then the studies are skewed towards proving impairment, rather than exploring if impairment exists at any and all levels. I've read quite a few, and one used multi-tasking to derive some results, the problem is multitasking while driving isn't just about how well you do it, it's when you do it. You don't do it on Talladega Speedway for a reason, but on an empty road at night going the speed limit, switching the radio station isn't much of an issue.

The irony is that impairment is based on the idea that people are good drivers to begin with, but many aren't. I honestly would love to be tested at different levels of inebriation while behind the wheel on a closed course mostly because I feel like I'm generally a better driver than most, mainly in terms of following most of the rules of the road. There are plenty of people who sadly would qualify as impaired drivers despite having no drug, prescription nor illegal, or alcohol impairment. And they're not just old people sadly.

I feel like this is an example of "A little bit of knowledge is a dangerous thing". Obviously you know how it works, but probably not good advice to the average driver. I know you've dealt with bad LEO in the past, but hopefully this doesn't encourage 'Sovereign Citizens' to be bolder beyond their understanding; to make folks more suspect

I've always talked to the officers doing the checks sometimes I might crack a joke or they might and everything goes smoothly. Maybe it's my personality but sitting there like a bump on a log ignoring the officer just seems like it's an exercise in acting like a jerk. But to each his own. Great and informative video.

Weird that this poped up. I seen his original police stop video that went viral a few years ago. But recently it was reported that he was arrested for something along the lines of involvement in prostitution or human trafficking. It could be that he was just an Uber driver taking clients to a location in which case it sounds like retaliation for the earlier viral video.

people - cops included - really hate being ignored, and as you state ignoring people is hard, you feel obliged to validate their existence, but, it's fun to watch people in authority being totally bewildered cos "they've heard it all before" but not silence. they need to feed that fire.

Hey, if you or anyone else sees this I do have a question - in NC, I know that you're supposed to announce if you have a firearm concealed , show the CCW etc. Allegedly I know if the stop goes as smooth as this one it a non issue, but if the cop gets shitty and vio0late and I didnt immediately tell him Im afraid that'll in up screwing me

Does anyone have any advice how to deal with this situationn? Ihave a few ideas but rather hear it from a professional to minimize risk

You don't have to legally respond back nor roll your window further down but makes me wonder if nonresponse antagonizes the officer and exacerbates the situation because they think you've got something to hide. Yeah don't talk if you've got alcohol on your breath but wouldn't it be better to be on friendly terms if you haven't had anything to drink and just get through the checkpoint.

Just seeing how you were nervous changed my physiology. IMHO if you haven't had anything to drink, why not be friendly just to get through the checkpoint without pumping stress hormones in our own bloodstream .
