👨‍⚖️💰 ~ The Supreme Court recently made bribery extremely difficult to prosecute on a federal level. It was a 6vs3 decision, with all the justices appointed by a Republican president saying that bribery is much more difficult to prove.

A local politician gave a huge contract to a businessman, and then showed up a few weeks later and asked for like $25,000 in cash as a “gift“. It might’ve been 15,000 or something like that. The Supreme Court said that is NOT ILLEGAL according to federal law anymore. They said that’s basically just a gift and you’re allowed to give/lobby politicians. They said it was only illegal if there was a specific agreement beforehand that the politician will do one thing and the businessman will give them something of value in return, which is called quid pro quo. I’m actually not sure if this applies to state level prosecutions as well or not, but a lot of times the only one to go after local politicians for bribery is the FBI. So no matter what this Supreme Court decision has very negative consequences.

But the Supreme Court to me has gone crazy or they don’t want to be prosecuted for the money they take, especially Clarence Thomas. Because think about it, even if it honestly is not quid pro quo agreement, you know the Businessman is going to quickly catch on that if they don’t pay the politicians money than they won’t get the contract renewed in the future or they may be retaliated against in some other way. And of course you also have the problem of now the FBI has to PROVE there was a specific agreement before anything ever happened. Following the money is one thing, and that’s kind of easy compared to having to prove what someone did or said before the transaction took place. Because unless somebody recorded it or is willing to testify, it’s basically impossible to prove.

So they’ve taken a situation where too many people get away with lobbying/bribery, and now made it extremely more difficult to prosecute. Ridiculous decision.
