Hi there. I have an i140 consular petition approved through EB3 Professional Visa, considering that the expectation to arrive is getting longer with the retrogration on the visa bulletin. Can I seek an H1B Visa to get into the US quicker and when the visa bulleting reachs my priority date I than change from H1B to EB3 visa? Is that a possibility? Would you advise me to take this path? Thank you in advance.

Hi, is still required for the green card to be vaccinated against covid 19? Is a requirement for the H1B visa too?
And for instance if a person get the H1B, could be sponsorised for the green card in the while ? Thanks

I do need advice, Jim. I'm waiting for my Eb2 NIW visa interview in Nigeria, but the visa bulletin has retrogressed. However, I got a postdoc offer in US, and the university is ready to file for H1b visa. Would the H1b visa impact my awaiting Eb2 visa interview negatively?

I do have a question. If I transfer my H1B visa and it gets accepted while I still have one year remaining on my three-year visa, will I just be able to use that one year before it expires, or will I be granted three years as if it were year one if my application is approved? Thanks!

I didn't get h1b (I am currently on my stemp opt). I am an indian citizen. My company tried if they could file for an Eb2 or eb3 visa, but the lawyer said that the wait time is so long that it could be useless in my case. My last day of opt is july 31st. Is there anything that can be done in my case(except cpt). I was under the impression that as long as my company files for an eb2 or eb3 is filed, i could keep working for my company

I currently stay in Canada. I got my H1b Visa done in Canada, but my family lives in India. I have a plan to go US in the June of this Year. My wife's Visa Interview is scheduled in APRIL, where she is going alone.

I have no idea if she is allowed to go for the VISA interview without me. If so when I move to US in June, can she travel from India and meet me in US.

Contents of your videos are so helpful, thanks so much! .....Please, accept my apologies for this long comment but I could not summarize my question in a shorter way....Thanks in advance for you understanding....: I am a former research scholar from Massachusetts Institute of Technology, Harvard and Columbia universities; a scholar with PhD. USCIS denied my US visa application during Trump's administration and his "Muslim Ban". (I am a Muslim-majority country). My immigration attorney applied for "Motion to Reopen" with additional documents to show why this USCIS denial is a mistake by them. USCIS dismissed "Motion to Reopen" WITH THEIR INCORRECT DEADLINE! (during Trump's administration and "Muslim Ban"). At that time, my immigration attorney wrote to me an e-mail and expressed that she decided to CLOSE her immigration attorney office and was not able to get A NEW CASE, and she was not able to send a letter to USCIS to CORRECT this INCORRECT DEADLINE stated by the USCIS (?). She left me ALONE! ......I am not able to go back to my home country because the government closed down the university where I was working as a professor; government closed down several universities as well (in 2016): According to the government claim, those universities have connection with a terrorist organization (!!?), and all of their academic staffs were dismissed including me. All my academic colleagues had to leave their academic careers.....In the U.S., my US visa issue turned into a chaos. None of immigration attorneys did not send a letter to USCIS to CORRECT its INCORRECT deadline. Life was a kind of torture; I was all alone in the U.S....Finally, when President Biden took the office and removed "Muslim Ban", I wrote my case to him, attached copies of official USCIS documents, etc. and CC my letter and its attachments to Vice President Kamala Harris, former President Barack Obama, and Nancy Pelosi....White House sent me a response: As they wrote, they reviewed my case; thank me to share my case with President Biden, he is honored by the opportunity to serve me (their language was completely different than Trump, USCIS during his administration, etc.), and transferred my letter and its attachments to relevant Federal Agency for FURTHER ACTION.....Then, I received an e-mail by USCIS...Their language was kind (totally different from previous USCIS), explained their regret, etc. However, there was no RESOLUTION in their email to my case. Furthermore, in their email, there is ANOTHER INCORRECT DATE about my last U.S. visa application!!! ......In my home country, my academic colleagues from my (closed) university are still not able to return to their academic career due to the government's persecution. (The government "never" conducted a fair investigation about us; "all academic staffs and all other staffs" were dismissed by the government while closing our universities with its claim about our universities' connection with a terrorist organization.....I am still in the process of trying to resolve my case in the US.....I lost my years!!!! due to INCORRECT deadline stated by USCIS (during Trump) and my immigration attorney!!! Then, I learned that my immigration attorney ( who wrote to me that she decided to close her immigration attorney office ) began her PhD!!!!!!!!!!!!!......I am an accomplished scholar with PhD, former scholar from MIT, Harvard and Columbia universities; she did not send a letter to USCIS to correct their clear INCORRECT deadline; and I learned that she began to conduct her PhD!!!!!!!!!......Is it NORMAL in the U.S. immigration law??????.....I am going to send my SECOND letter to the President Biden!....and CC'd USCIS director, Barack Obama, etc....Do you have any suggestion for me......thanks in advance for your time.

I tried asking Andrew about the Green-card based employment option Jim, my employer is willing to file one for me, but Andrew blatantly said that he would not advise my employer to apply for one because it is expensive. I was shocked because my employer that l have been working with for more than four years is willing to file one for me but, “my attorney’s” interest changed, despite the fact that l hired LH to oversee my immigration case. I like your detailed explanation Jim but in the actual fact l got a different impression from your organization in the real practice.
