Even though it is a bit unrealistic, he did play a good mental trick by saying he would make he responsible for making his soldiered murderers. They started doubting themselves, mostly because the other side is a representative of the Judicial system, not an enemy army, not civilians, but federal officers.

This movie is written from a perspective of someone who has never served in the military, when Denzel eludes that the General's men may hesitate to follow, he confused a loyal soldier with a government servant who can be bought and let their emotions get in the way. When the commanding office is loved by his men, they will go into the depths of hell with him if he gave the order to.

Except no solider is going to take the order of some general to execute federal officers. It is more likely they would either lower the guns or look at the fellow brothers and point at the officer giving them an UNLAWFUL ORDER. Believe it or not, Soldier and Sailor follow order because the order makes sense. If an officer gives an order especially like this, my weapon would be pointed at them or just chose to follow the UCMJ and not follow the order until it has been confirmed as a lawful order.

The irony of politics is that powerful people will tell you what needs to get done. They will outline how, when, where, and to whom it must be applied. Good officers will outline the drawbacks and cons to performing such a job. Especially if the cost is greater than the return at its end and completion.

The powerful people, however, don't care. Their image and response to a "crisis" is what is important for future elections. Not the immediate costs and effects that might be incurred from such a decision.

Then these men, true to their word and oaths, carry out these orders. They may not agree, but they can get behind the mission and what its trying to achieve (at least what they've been told).

Then the powerful people, once the things that said GOOD OFFICERS stated would occur begin occurring and showing that it probably was not a great idea, clutch their pearls and try to hold the men they ordered to perform, accountable for the actions that they ordered in the first place.

A military officer CAN NOT ENACT Martial Law on US territory. Only an elected official, and only in a time of emergency that matches the necessity for military presence (like widespread riots, or natural disasters, or in the case of war that has reached the homeland).

What makes this interesting is that it seems the Major General warned against Martial Law. And when it went into place, at that point, it seems that the situation had gotten so terribly bad that it was presumptuously to the point of counter-insurgency.

While the innocent man did not deserve to be tortured to death... The man's blood is not just on the hands of the men who tortured him, but on the Leaders who unshackled those men instead of finding alternatives to whatever issue they were trying to pacify.

So the people who enacted the Martial Law are now quietly allowed to get away with it. But the men ORDERED to do it, are held accountable for those actions... And all other actions taken... Despite it being Martial Law and an order of the elected government...

For the Powerful People, they get to play both sides because civilians are too stupid to realize that the Government actively works against them, and the soldier just happened to be an idiotically willing pawn in their game of Power Exercise. The FBI comes in to be the "hero", but doesn't go after the culprits who okayed it in the first place.

Deveraux becomes the Scapegoat and the Politicians walk away scott free and the FBI get to have their publicity win...

Note:
I was a Soldier in the Army, and if I was given the order to unalive Federal Agents, I wouldn't have thought twice... Murderer or not in their eyes.

After 9-11, none of this happened. Citizens and non-citizens alike were detained, tortured, and disappeared, but the DOJ did not come to their rescue. Instead they wrote guidelines on how their rendition was legal.
No generals were ever arrested for their wartime conduct, because their conduct received the highest sanction. Only low-ranking officers and soldiers were ever prosecuted, and only because their actions were caught on camera and they were outed by whistleblowers to the media.
People marched and rallied, but far more turned their backs and allowed these actions to go unchallenged.

As a people, we failed to live up to our own ideals, to hold our leaders at the time accountable. In time we paid for this indifference with blood, treasure, and the rise of authoritarian reactionary movements.
We murdered our own democracy in the interest “of saving it.”
