So basically India got legal control of Kashmir out of power plays and then didn't agree anymore with Kashmir being independent, although it was the will of the people. So basically India stepped onto the self-determination right of people, hence it shouldn't have any claim on Kashmir from a UN charter perspective.

It is against democracy and human rights furthermore referendum in Kashmir is our right in the light of International Law, no one can deny it, we the Kashmiri people must be given right to choose our future.
