If yes when can i take itc in first instalment or last instalment

if payment has to be made in let's say 270 days, and u take ITC from 1st day, then you have to pay interest on that ITC amount. If you dont take ITC or take ITC as per payment agreement only, then u dont have to pay interest. Otherwise interest liability will be there if you dont make payment to supplier but take credit in respect of that payment

Same Reply given by me to the gst audit department but still he has show cause us to pay the interest amount ...Which we have not accepted....Can we go for appeal as interest amount is also very big

Hello, Please tell if a purchase party is not giving the payment of goods sold on (GST bill + Eway Bill) and the payment days exceed 180 day. How we can ask GST office to reverse our ITC as the purchase party didn't pay us any amount. And that purchase party had cancelled his GST can we still file application/case on him.

180 days from issuance of tax invoice. tax liability arises at the time of supply and time of supply is completed in all cases where there is issue of invoice to the extent of supply mentioned in tax invoice. so the recepient is deem to have receipt of supply as mentioned in invoice so he is liable to pay tax mentioned in invoice irrespective of what is there personal agreement between parties of transactions. proviso of sec 16(2) doesn't give damn to your personal agreement. if your liable to pay tax as per time of supply, you must pay it not exceeding 180 days.

there is already option of itc reversal in gstr 3b so one should reverse it through it as gstr 3b is used in place of gstr 2 for inward supplies ..

one can not be rich himself on the expense of others .gst is money of govt . one can not take itc of it without payment of it . I am sure there must be some penalty for such activity.

if receiver fails to pay amount to supplier within 180 days than section 16 read with Rule 37 will be applicable. Agreement logic will not be accepted by govt.

Sir me ek company me hu hum subcontracting me deal krte h to purchase order me bhut si condition hoti .
Vendor A ne goods diya 1jan 2021 ko and usne tax invoice diya same date but purchase order ki condition fullfil nhi ki or tax invoice return kr diya vendor ko ki condition fullfil kro
Vendor condition fullfil krta h or after 180days k bad invoice bejta h
Or me payment krta hu without tax only cost to cost because muje ab ITC nhi milega to me esa kr skta
1. Auditor bolta h apne 180days me payment nhi kiya .
2 recipient failed nhi tha payment ko lekar .
Plz give some case study or ITC information that case

Agar buyer ne time pe payment kiya ho or supplier ne 180 days k baad gst return pay kiya to buyer ko itc milega kya? Nahi milega to uske liye kya padega?
