Clark v. Martinez | 543 U.S. 371 (2005)

In nineteen eighty, migrants left Mariel port in Cuba. About one hundred twenty-five thousand Marielitos arrived in the United States. When Cuba wouldn’t repatriate two Marielitos, the legal battle over their detention escalated to the Supreme Court in Clark versus Martinez.

Sergio Martinez was convicted of crimes in two states. Similarly, a Florida court convicted Daniel Benitez of grand theft. These convictions rendered Martinez and Benitez, both Marielitos, inadmissible under U S law, so the government denied their lawful-permanent-resident applications. Then, both received additional felony convictions.

The government detained the Marielitos, completed removal proceedings, and ordered removal to Cuba. At the time, Cuba wouldn’t even consider the repatriation of Cubans, and the Marielitos remained in custody for more than six months, significantly longer than the government’s ninety-day repatriation period.

The Marielitos filed separate actions seeking release against government officials, including director Clark. The district court released Martinez because removal was unlikely. The Ninth Circuit affirmed. In Benitez’s case, another district court found removal unlikely but allowed continued detention. The Eleventh Circuit affirmed. The Supreme Court granted cert to address both cases.
