This guy is 100% at fault. No speed limit does not mean you can drive as fast as you want all the time. There is a reason you will take partial blame for an accident when you drive faster than 130 even in zones with no speed limit. Especially on a two lane road. The merging car is making space for the car on the very right. Ideally he should either increase speed by a bit or slow down so the car can merge but switching to the left is also an option.
