Cinematic Effect Cant Be Enabled error message in FCP! Cinematic Mode in iOS 16 is Broken!

so after getting my iPhone 14 pro and shooting some video in cinematic mode I came across the issue and error. "Cinematic Effect Cant Be Enabled". So it really doesn't look like there is any kind of true workaround for this error. Is anyone else getting the "Cinematic Effect Cant Be Enabled" error message? This is with iOS 16.0.3 and the current version of both final cut pro (FCP) as well as iMovie on the mac.
