According to Supreme Court the panel that involves the Chief Justice in the selection process of EC stands until a proper law is proposed to stop the illegal practice in appointing or extending the tenure of Election Commissioner. The basic purpose to stop BJP appointing Commissioners of their choice and ensure malpractices are avoided. BJP in reality has thrived on malpractices to come to power. Court wouldn't have interfered in this process unless petitions from public and opposition filed. Public convinced by unconstitutional practices in the last ten years amounting to depriving the voting rights of the people like tampering of EVM machines, purchasing elected MLAs and MPs from other parties. This has become an issue therefore SC has rightly interfered taking notice of the threat to the constitutional rights of the people.

Bills can always be challenged before it becomes a law if suspicion rises.

However once the matter is challenged in the court bill to be passed will be delayed. Possibilities for the bill proposed to be quashed.

Under such delay court ruling that Chief Justice to be part of selection panel of appointing Election Commissioner stands.

The judiciary is alert and won't make things easy for the Center to have its way.

I don't know the current procedure, but in my opinion the following will ensure the independence of the above officials:
1) The selection committee consists of the PM, LOP, and CJI.
2) The MHA proposes the name(s).
(3) The Selection Committee recommends a name for the President's approval.
(4) The President may approve or ask the Selection Committee to reconsider its recommendation.
4) If the Selection Committee recommends the same name, the President is bound to approve.
