Yeah... so long as writers have criminals like this as the kind of thugs that Batman beats up on a regular basis, I don't mind if he kills them or not. If he's the kind of superhero who doesn't kill, then his villains should try to keep up the same act. If they do kill, it should be between criminals, not the average joe (maybe on special occasions, but they'd keep it clean and not make a show of it). Batman's villains also include mobsters, so the idea that they'd have a sort of code would make sense -- the cops don't nab them because they keep quiet and grease their palms, Batman doesn't take notes from Lex Luthor and hide bombs in their cars because they avoid unnecessary bloodshed. The criminals are weird enough that regular police are in over their head half the time, it's OK for Batman to be a reactionary counter to that weirdness.

This is part of what made Arkham Asylum so unique.
Unlike the other games, these guys weren't just some poor bastards who were trying to get by in the worst way possible.
They were mentally ill people who were locked in an asylum and worked for the most deranged dude alive.
