How to Check if a Product is PATENTED or TRADEMARKED (VERY IMPORTANT!) for Selling on Amazon

Let me ask u something, If you have ever came upon this issue, I sell in Canada, use JS, sometimes JS gives me the wrong info, for example, every single product is at 150 Monthly search volume, Ive contacted JS about this, they tell me to re-do my Search find, completely re-do it, its annoying but it does for a a week or two but than does the same thing, and at times I find certain products that are listed on the JS site Opportunity finder, then the next day later its gone, its no longer there anymore, and my main issue is when I use the JS extension under and Amazon site i get a completely different Opportunity score than from the JS Site, why is that?

Can a take a product from a Chinese company that is sold on amazon already by that company, but also sold in bulk in alibaba (original, not a copy), modify it and sell it on amazon? I don't necessarily have to hide the original companies name but the modification I want to make to the product currently does not exist and I see a demand for it.

For example say a table lamp that is powered by electricity. I take it, modify it to power it using batteries and sell on Amazon because there might be a need for people to power that device using batteries and that is currently not sold. The product would be sold for more for my trouble of adding parts to be able to be able to power by batteries.
